The Commission Terms of Service of KamanderKato
-------------------------------------------------------------------------------------------By commissioning me, no matter what product you purchase, you state that you understand and agree to the terms listed below.-------------------------------------------------------------------------------------------I: General StuffI.I You acknowledge that I, KamanderKato, am selling digital goods and that you, the client, will not receive a physical product through this purchase. You will receive the high resolution .png file of the illustration through Discord, DM, Note, or the email connected to your Paypal, depending on your personal preference.I.II The client is to provide one or multiple visual references for the character they would like to commission a product of. Written descriptions and backstory can help KamanderKato identify smaller details in their designs and assist in getting a better grasp of the character if included, but KamanderKato can’t work off of that alone unless it’s a commission type where creating a character is the intention.I.II.I. I.I.II.V Heavy GoreI.II.II. If the client is unsure that a character or illustration idea would fall under any of these categories, they can ask in DM/Note.I.II.III. KamanderKato has the right to refuse any commission order for any reason.II: The ProcessII.I.To apply for a slot, the commissioner will fill out a google form specifying what they want for their piece(s).
II.I.I If accepted, the commissioner will receive an invoice in their paypal email. KamanderKato may message the commissioner to ask some questions after the form is submitted, depending on the content of the form and if KamanderKato has a good understanding of what the commissioner would want for their piece(s).
II.I.II If you haven't received a message or invoice within 48 hours of submitting your response, then your commission has been denied.II.II. Works in progress will be provided upon request. In the event that they are requested, the client will receive .jpg files of each stage of the commission.II.III. After payment for a commission has been accepted, the expected time frame it could take to complete the commission is about a month. If the illustration can’t be completed within that time, the client will be notified through DM/Note.
II.III.I KamanderKato cannot guarantee that a commission will be completed by a specific date.II.IV. The client is able to request three small changes and one big change to a product before edits cost extra. Changes to an illustration during the sketch stage are exempt from this rule.III: PaymentIII.I I accept USD as PaymentIII.II USD Payments are made through Paypal Invoice. The client’s paypal address is required to send the invoice and can be sent discreetly through the google form.III.III Refund InfoIII.III.I. If a refund is requested before the commission is started, a full refund will be issued.III.III.I.I If a refund is requested during the sketching stage, the client will receive 75% of the funds given back and a high quality .png file of the finished sketch.
III.III.I.II. If a refund is requested during the lineart stage, the client will receive 50% of the funds given back and a high quality png file of the finished lineart.
III.III.I.III. Any refunds requested after the coloring stage will be denied.
III.III.III. If KamanderKato cannot complete the commission for any reason, the commission will be refunded in full regardless of how far KamanderKato had gotten into it. In this circumstance, If work was already done on the illustration, the client will receive a high quality .png of what KamanderKato had completed.IV: Usage RightsIV.I. KamanderKato holds the rights to the artwork itself, the right to post it on social media, and the right to use it as a portfolio example unless explicitly asked by the client to not do so before a week within the artworks completion.
IV.I.I The client holds the character’s depicted in the artwork as their own unless it or one of the characters in the piece is from an intellectual property.IV.II. The client is able to repost any illustrations purchased from KamanderKato, so long as KamanderKato is credited as the artist.
IV.III.I. the client can make changes to the illustration on their own, so long as KamanderKato is credited as the original artist.IV.III. The client holds all rights to character designs purchased from KamanderKato, aside from the initial commissioned artwork of the character itself or, in the event that a base is used, the base used to create it.IV.IV.Clients are able to resell any character designs they have purchased from KamanderKato at any price.TOS v1.1.3: 9/20/2022 - Edited I.II.III
